Terms & Services

These terms outline the scope, process, payments, responsibilities, deliverables, and other conditions that apply to services provided by Faiqa Studio.

Please review the section relevant to your service before starting a project.

Website Design & Development Terms

1. Scope of Work & Deliverables

Website design and development services are limited to the pages, layouts, features, and functionalities specifically outlined in the approved project proposal or Statement of Work (SOW).

Any additional pages, features, custom animations, integrations, functionality, or other requests outside the approved scope will be treated as additional work and quoted separately.

2. Payment Milestones & Project Schedule

Projects follow the following standard payment structure:

50% Advance Payment: Due before project work begins.
50% Final Payment: Due upon final approval of the website and before domain connection, transfer of hosting or website access, delivery of administrative credentials, or publication of the website.

Delayed Payments: Faiqa Studio reserves the right to pause project work if a scheduled payment remains unpaid for more than seven (7) business days. Any resulting delay will be added to the project timeline.

3. Review & Revision Policy

The website design phase includes up to two (2) rounds of consolidated revisions.

Revision requests should be provided as one consolidated and actionable list whenever possible.

Requests made after approval of a project phase, or requests that require a significant change to the approved structure or design direction, may be treated as additional work and billed separately.

4. Client Content, Assets & Additional Creative Support

The Client is responsible for providing available website content and materials, including copy, images, videos, logos, brand guidelines, and any third-party codes or tracking scripts required for the project.

Where included in the selected package or separately agreed, Faiqa Studio may also provide services such as copywriting or copy editing, custom graphics, image sourcing or editing, and basic on-page SEO support.

The scope of any such services will depend on the selected package or approved proposal. Extensive copywriting, custom illustration, photography, advanced SEO, or additional creative production may be quoted separately.

Project timelines depend on the timely delivery of required content, assets, approvals, and feedback.

If requested materials or feedback are delayed by more than ten (10) business days, the project deadline may be adjusted accordingly.

5. Third-Party Services & Subscriptions

The Client is responsible for purchasing and maintaining any third-party services required for the website, including domain registration, hosting, website platforms, plugins, integrations, premium assets, and commercial licenses.

These services should be maintained under the Client's own account and billing information where applicable.

Faiqa Studio is not responsible for service interruptions, provider downtime, account suspension, subscription cancellation, or other issues caused by third-party service providers.

6. Browser Compatibility & Responsive Testing

Websites are designed and tested for responsive display across current major desktop and mobile browsers.

Faiqa Studio aims to ensure a consistent and functional experience across supported modern browsers. Outdated, discontinued, or unsupported browsers may not be fully compatible.

7. Post-Launch Bug-Fix Warranty

Faiqa Studio provides a fourteen (14) day post-launch warranty for functional bugs, broken links, or visual issues that are directly related to the approved project scope.

The warranty does not cover new content, new features, design changes, third-party service issues, platform updates, or modifications made by the Client or another service provider after launch.

Ongoing maintenance, updates, content changes, and additional development work are not included unless covered by a separate maintenance agreement.

8. Intellectual Property & Ownership

Upon receipt of full and final payment, ownership of the finalized website design, approved visual assets, and custom front-end development created specifically for the project is transferred to the Client, subject to any third-party licenses or assets used in the project.

Faiqa Studio retains the right to showcase the completed website, design work, screenshots, and related project materials in its portfolio, website, social media, case studies, and other promotional materials.

Website Redesign Terms

1. Scope of Work

Website redesign services are based on the existing website and the specific improvements outlined in the approved proposal or Statement of Work (SOW).

The scope may include visual redesign, layout improvements, page restructuring, responsive improvements, content updates, and other agreed changes.

New pages, features, integrations, custom functionality, or major development work outside the approved scope will be quoted separately.

2. Existing Website & Access

The Client is responsible for providing the required access to the website platform, hosting, domain, CMS, and other relevant services.

Faiqa Studio is not responsible for issues caused by the existing website, outdated plugins, third-party services, previous development work, or hosting/platform limitations unless specifically included in the project scope.

3. Content & Creative Support

The Client may provide existing content, images, videos, and brand assets.

Where included in the approved scope, Faiqa Studio may also provide copy editing, custom graphics, image sourcing/editing, and basic on-page SEO support.

Additional or extensive content, design, SEO, or development work may be quoted separately.

4. Revisions & Approval

Revisions are limited to the number and scope stated in the approved proposal.

Changes requested after approval or changes that significantly alter the agreed redesign direction may be treated as additional work.

5. Post-Redesign Warranty

Faiqa Studio provides a fourteen (14) day warranty for functional bugs, broken links, or visual issues directly related to the approved redesign work.

The warranty does not cover new requests, content changes, third-party issues, platform updates, or changes made by the Client or another service provider after completion.

6. Third-Party Services

Domain, hosting, plugins, premium assets, software, and other third-party services remain the Client's responsibility unless otherwise agreed.

7. Ownership

Upon full payment, ownership of the finalized redesign work created specifically for the Client transfers to the Client, subject to third-party licenses.

Faiqa Studio retains the right to showcase the completed redesign in its portfolio and marketing materials unless otherwise agreed in writing.

Website Maintenance Terms

1. Service Scope

Website maintenance services are provided according to the specific tasks and scope agreed with the Client.

Depending on the agreed service, maintenance may include content updates, text or image changes, minor layout adjustments, basic website updates, routine fixes, and other agreed website tasks.

New pages, major redesigns, custom features, complex development, integrations, or other work outside the agreed maintenance scope will be quoted separately.

2. Client Access & Responsibilities

The Client is responsible for providing the required website, hosting, domain, CMS, and third-party account access where necessary.

The Client must maintain active subscriptions, licenses, hosting, domain registration, and other third-party services required for the website.

3. Request & Turnaround

Maintenance requests should be submitted through the agreed communication channel with clear instructions and required content or assets.

Standard requests are generally completed within 2–3 business days, depending on complexity and workload.

Larger or technically complex requests may require a separate timeline and quotation.

4. Monthly Billing

Where maintenance is provided on a monthly basis, the agreed maintenance fee is billed in advance for each billing period.

Unused maintenance capacity or requests do not automatically roll over to the next billing period unless otherwise agreed.

5. Additional Work

Requests outside the agreed maintenance scope will be reviewed and quoted separately before work begins.

6. Third-Party Issues

Faiqa Studio is not responsible for issues caused by hosting providers, plugins, website platforms, domain providers, software updates, third-party integrations, or changes made by the Client or another service provider.

7. Cancellation

Maintenance services are provided on a month-to-month basis unless otherwise agreed.

Either party may choose not to continue for the next billing period. Fees already paid for the current billing period are non-refundable.

8. Ownership

The Client retains ownership of their website, content, and existing assets. Any new custom work created by Faiqa Studio becomes the Client's property once all applicable payments have been made, subject to third-party licenses.

Branding & Visual Identity Terms

1. Scope & Creative Process

Branding services are limited to the deliverables included in the approved package or proposal, such as primary logos, secondary logos, submarks, color palettes, typography, and brand guidelines.

Faiqa Studio may present two (2) to three (3) distinct initial creative directions based on the approved creative brief and project requirements.

The Client selects one (1) direction to move forward with for refinement and finalization.

2. Revision Policy

The selected branding direction includes up to three (3) rounds of revisions.

Revisions may include reasonable adjustments to colors, typography, spacing, proportions, icons, and other elements within the selected creative direction.

Requesting a completely new concept or creative direction after a direction has been selected and refined is considered outside the agreed scope and may require an additional concept fee.

3. Deliverable Formats & File Delivery

After final approval and receipt of full payment, final brand assets will be provided in standard industry formats appropriate to the agreed deliverables.

Typical file formats may include:
Vector Files: AI, SVG, and EPS.
Digital Files: PNG and JPG.

Final source files and approved assets will be delivered through an agreed cloud storage or file-sharing method.

4. Font Licensing & Third-Party Assets

Faiqa Studio may recommend and use professional fonts, stock assets, icons, mockups, or other third-party resources as part of the branding process.

Where a commercial license is required, the Client is responsible for purchasing and maintaining the appropriate license unless otherwise agreed in writing.

Third-party assets remain subject to their respective licensing terms.

5. Trademark & Legal Clearance

Faiqa Studio creates original design work based on the information and requirements provided by the Client.

However, Faiqa Studio does not provide legal trademark searches, copyright clearance, patent searches, or intellectual property registration services.

The Client is responsible for conducting appropriate legal checks and registering or protecting the brand where required.

6. Copyright & Portfolio Rights

Upon receipt of full payment, commercial rights to the finalized and approved logo and brand assets created specifically for the Client are transferred to the Client, subject to any applicable third-party licenses.

Unselected concepts, sketches, rejected directions, and unused design explorations remain the intellectual property of Faiqa Studio and may not be used, reproduced, modified, or distributed by the Client without written permission.

Faiqa Studio retains the right to showcase the completed branding work in its portfolio, website, social media, case studies, and other promotional materials.

Social Media & Graphic Design Retainer Terms

1. Retainer Scope & Deliverables

Monthly design retainers cover the graphic design services and deliverables specified in the approved client package.

Depending on the selected package, deliverables may include social media graphics, carousel designs, presentation decks, advertisements, banners, and other digital marketing materials.

Major standalone projects, such as complete brand identities, website design and development, video production, or other complex projects, are not included unless specifically stated in the agreement and will be quoted separately.

2. Work Requests & Turnaround Times

All design requests should be submitted through the agreed communication channel with a clear brief, required content, and relevant assets.

The standard turnaround time is approximately forty-eight (48) to seventy-two (72) business hours per standard design deliverable or revision.

Complex projects, multi-page presentations, detailed infographics, or high-volume requests may require additional time. Timelines for such work will be communicated after reviewing the brief.

3. Billing & No-Rollover Policy

Graphic design retainers are billed in advance every thirty (30) days unless otherwise agreed in writing.
Unused design capacity, deliverables, or allocated requests do not automatically roll over to the following billing period.

The monthly retainer reserves dedicated agency capacity, availability, and priority within Faiqa Studio's workflow.

4. Approvals & Revisions

Each design deliverable includes reasonable minor revisions based on the original approved brief.

Revision requests should remain within the original scope and creative direction.

Once a design has been approved or published, any subsequent changes will be treated as a new request and will be handled within the available capacity of the current billing period.

5. Client-Provided Materials & Copyright

The Client is responsible for ensuring that all images, logos, text, fonts, videos, and other materials provided to Faiqa Studio are owned by the Client or properly licensed for use.

Faiqa Studio is not responsible for copyright or licensing issues arising from materials supplied by the Client.

6. Retainer Cancellation

Design retainers operate on a month-to-month basis unless a different minimum term has been agreed in writing.

Either party may terminate the retainer by providing fourteen (14) days' written notice before the next scheduled renewal date.

Payments made for the current billing period are non-refundable, and any completed or committed work remains payable.

Cold Email Outreach Terms

1. Initial Contract Term & Commitment

Managed Cold Email Outreach services begin with an initial three (3) month commitment.
The initial term allows sufficient time for campaign setup, testing, optimization, and performance evaluation.

Month 1
Infrastructure setup, DNS authentication, mailbox warmup, ICP definition, prospect research, campaign strategy, copy development, and initial campaign launch.

Month 2
Campaign execution, follow-ups, inbox management, reply handling, and initial optimization.

Month 3
Continued optimization, pipeline development, campaign refinement, and performance analysis.

After the initial three (3) month term, the service continues on a month-to-month basis unless cancelled in accordance with these terms.

2. Monthly Renewal

Following the initial three (3) month commitment, the service automatically continues on a monthly basis at the agreed package rate.

No new long-term contract is required for each monthly renewal.

If pricing, scope, deliverables, or infrastructure requirements change, the Client will be informed before the updated terms take effect.

3. Cancellation & Early Termination

After the initial three (3) month commitment, either party may choose not to continue the service for the following billing period by providing at least fourteen (14) days' written notice before the next billing date.

Cancellation requests must be submitted through email or another agreed written communication channel.
Once the applicable notice period has been completed, no further monthly renewal will be charged.

If the Client requests cancellation before the initial three (3) month commitment has ended, the remaining commitment will continue to apply unless both parties agree otherwise in writing.

Fees already paid for an active billing period or completed setup work are non-refundable.

4. Fees, Billing & Invoicing

Setup Fee
A one-time setup fee is charged before technical setup begins:
  • Starter: $150
  • Growth: $200
  • Scale: Custom pricing

The setup fee covers campaign infrastructure, DNS configuration, mailbox setup, warmup management, initial prospect research, and campaign copy preparation.

The setup fee becomes non-refundable once technical work has commenced.

Initial Warmup Period
New domains and mailboxes may require an initial warmup period, typically fourteen (14) to twenty-one (21) days, depending on the campaign setup.

Active outreach does not begin until the required infrastructure is considered ready for campaign use.
No monthly base retainer is charged during the initial setup and warmup period unless otherwise stated in the project agreement.

Monthly Retainer
The monthly base retainer begins when active outreach launches and is billed in advance every thirty (30) days.

Current standard package pricing:
  • Starter: $300/month
  • Growth: $500/month
  • Scale: Custom pricing

Performance Fee
A performance fee of $100 is charged for each qualified meeting that is actually attended, according to the qualification criteria below.

Qualified meetings are reviewed and invoiced at the end of each applicable billing period.

5. Qualified Meeting Criteria

A meeting qualifies for the performance fee only when all of the following conditions are met:

Campaign Sourced
The meeting was booked directly through the outreach campaign managed by Faiqa Studio.

ICP & Decision-Maker Match
The prospect matches the agreed target criteria, including relevant role, industry, geography, company size, or other ICP requirements.

Approved Campaign
The prospect booked the meeting in response to the approved outreach campaign and its associated messaging or offer.

Attendance
The prospect attends the scheduled meeting for at least ten (10) minutes.

6. Non-Billable Meetings

A meeting will not be considered billable when:
  • The prospect does not attend the meeting.
  • The attendee is a job seeker or student.
  • The attendee joins primarily to sell or pitch their own products or services.
  • The meeting is cancelled before the scheduled time and is not rescheduled within the applicable billing period.
  • The meeting does not meet the agreed ICP requirements.

Any meeting dispute or no-show should be reported in writing within forty-eight (48) hours of the scheduled meeting.

7. Campaign Infrastructure & Ownership

Campaign infrastructure will be established according to the agreed setup.
Client-owned domains, mailboxes, and third-party accounts purchased specifically for the campaign remain the Client's property.

Where applicable, campaign-related prospect databases and campaign data generated specifically for the Client will be provided to the Client according to the agreed service scope.

Third-party software, sending platforms, data credits, domains, mailboxes, and other external services are subject to the pricing and terms of their respective providers.

8. Responsible Outreach & Compliance

Faiqa Studio follows responsible B2B outreach practices and designs campaigns with applicable email, privacy, and marketing requirements in mind.

Campaign processes may include:
  • Accurate sender identification.
  • Non-deceptive subject lines and messaging.
  • Relevant B2B targeting.
  • Appropriate business-purpose messaging.
  • Clear opt-out instructions.
  • Suppression of contacts who request no further communication.
  • Reasonable filtering of invalid or risky email addresses.
  • Secure handling of campaign data.
  • Compliance with applicable email-sending platform policies.

For campaigns targeting the United States, campaign practices are designed with applicable CAN-SPAM requirements in mind, including accurate sender information, non-deceptive subject lines, a valid physical postal address, and an opt-out mechanism.

For campaigns targeting the UK or European markets, applicable privacy and electronic-marketing requirements may vary depending on the recipient, business structure, data being processed, jurisdiction, and campaign circumstances. UK guidance, for example, distinguishes corporate subscribers from sole traders and certain partnerships.

No campaign can be represented as universally or automatically "100% legally compliant" across all jurisdictions.
The Client remains responsible for obtaining legal advice specific to its business, offer, target market, and jurisdictions where required.

9. Opt-Out & Suppression

Managed campaigns include an opt-out and suppression process.
When a prospect requests no further marketing communication, Faiqa Studio will remove or suppress that contact from future campaign outreach within the managed campaign.

The Client must inform Faiqa Studio of any contacts who have previously opted out or should not be contacted.

10. Data Verification & Deliverability

Business contact information is researched and verified using available data sources and verification methods.
Email verification reflects the status of an email address at the time it is checked and does not guarantee future deliverability.

Where detectable, invalid and high-risk addresses, including catch-all addresses, may be filtered according to the agreed data process.
Business information can change over time, and permanent data accuracy cannot be guaranteed.

Faiqa Studio may implement standard deliverability practices such as DNS authentication, mailbox configuration, and gradual sending.
However, inbox placement, spam filtering, bounce rates, sender reputation, and email-provider algorithms are controlled by external systems and therefore cannot be guaranteed.

11. Campaign Results

Faiqa Studio manages the agreed campaign activities, which may include targeting, prospect research, messaging, follow-ups, inbox management, and campaign optimization.

Campaign performance depends on multiple factors, including the Client's offer, pricing, ICP, market demand, timing, messaging, reputation, prospect interest, and sales process.

Therefore, specific numbers of emails opened, replies, meetings, opportunities, revenue, or closed sales are not guaranteed.

12. Prospect Volume & Email Sends

"Prospects Contacted" refers to the number of unique prospects enrolled into the campaign during the applicable billing period.

A prospect may receive an initial email and multiple follow-up emails.

Therefore, the number of unique prospects contacted is different from the total number of outbound email sends.

13. Client Responsibilities

The Client is responsible for providing accurate and current:

  • Business and service information.
  • Product and offer details.
  • Target market and ICP criteria.
  • Pricing and commercial information.
  • Calendar availability.
  • Timely campaign approvals and feedback.
  • Accurate claims and information used in campaign messaging.

The Client confirms that the products, services, offers, and claims promoted through the campaign are lawful, accurate, and properly substantiated.

14. Legal Notice

Faiqa Studio provides B2B outbound lead-generation and campaign-management services. These terms describe the commercial relationship between Faiqa Studio and the Client and do not constitute legal advice.

Marketing, privacy, and electronic-communications laws vary by jurisdiction and may change over time. The Client remains responsible for obtaining appropriate legal advice and ensuring that its business, offer, data use, and marketing activities comply with applicable laws.

B2B Lead Generation & Prospect List Building Terms

1. Scope of Service

Faiqa Studio provides custom-researched B2B prospect lists based on the Ideal Customer Profile (ICP) criteria approved by the Client.

Targeting criteria may include:

  • Job title or role
  • Industry
  • Company size
  • Geography
  • Company type
  • Other agreed business criteria

The final list will contain the data fields included in the approved package.
Standard data fields may include:

  • Prospect First Name & Last Name
  • Business Email Address
  • Current Job Title / Role
  • Prospect LinkedIn Profile URL
  • Company Name
  • Company Website
  • Company Industry
  • Company Employee Headcount
  • Company Location
  • Company LinkedIn Profile URL

2. Phone Number Exclusion

Faiqa Studio's standard list-building service focuses on digital and email-based B2B prospect data.

Direct telephone numbers, personal mobile numbers, and cold-calling records are not included unless specifically agreed in writing as part of a custom project.

3. Minimum Order & Delivery Timeline

The minimum order for standalone prospect list building is 1,000 verified leads unless otherwise agreed in writing.
Standard estimated delivery timelines are:

  • 1,000 leads: 3 business days
  • 3,000 leads: 5 business days
  • 5,000 leads: 7 business days
  • 5,000+ leads: Timeline confirmed separately in the project SOW

Delivery timelines begin after receipt of the required advance payment and approval of the targeting sample.

4. Two-Stage Workflow

Stage 1 — ICP Sample
Before full list production, Faiqa Studio provides a sample of approximately twenty (20) to fifty (50) prospects matching the agreed ICP.

Email addresses may be masked or withheld during the sample stage to protect verification resources and third-party data credits.

The Client should review the sample and provide approval or specific targeting adjustments within forty-eight (48) hours.

Stage 2 — Full List Production
After sample approval, Faiqa Studio proceeds with the full research, cleaning, and verification process.

Once production begins, fundamental changes to the approved ICP may require additional research time or fees.

5. Payment & File Release

A 50% advance payment is required before project kickoff and sample creation.

The remaining 50% balance is due upon completion of the ordered list.

Before final payment, Faiqa Studio may provide reasonable proof of completion, such as a row-count preview, verification report, or blurred spreadsheet preview.

Full edit/download access to the completed list is released after receipt of the final balance.
Raw or complete databases will not be released before the project invoice has been fully settled.

6. Tooling & Data Costs

Internal research tools, verification services, data credits, and other third-party resources required to fulfill the agreed list-building project are included in the quoted project price unless otherwise stated in writing.

The Client will not be charged separate software fees by Faiqa Studio for standard list-building fulfillment.

7. Email Verification Standard

Faiqa Studio uses professional verification methods to identify invalid, risky, or otherwise unsuitable business email addresses where detectable.

The target standard is a minimum 95% valid email rate at the time of verification and file delivery.

This is a data-validation standard and should not be interpreted as a guarantee of future inbox delivery or campaign performance.

8. Hard-Bounce Replacement Policy

If the Client experiences hard-bounce rates exceeding 5% from the delivered list, Faiqa Studio will review the affected records and, where the bounce is attributable to inaccurate or invalid data present at the time of delivery, provide replacement contacts where reasonably available.

The Client must provide the relevant bounce report or export from the sending platform within seven (7) business days of list delivery.

Bounces caused by factors outside the accuracy of the supplied contact data, including Client-side domain reputation, sending configuration, blacklisting, mailbox issues, or other campaign infrastructure problems, do not qualify for replacement.

9. Data Sources & Privacy

Faiqa Studio may use publicly available business information, professional networks, company websites, business directories, and third-party data or verification services as part of the research process.

Faiqa Studio does not guarantee that every source will remain available or that business information will remain unchanged after delivery.

The Client is responsible for using the delivered data lawfully and in accordance with applicable privacy, marketing, data-protection, and electronic-communication requirements.

Where personal data is involved, the legal responsibilities of each party may depend on the applicable jurisdiction and the specific way the data is collected, processed, and used.

10. Data Accuracy Disclaimer

Business contact information can change because employees change roles, companies restructure, domains expire, or email accounts are disabled.

Therefore, verification reflects the information available and the verification status at the time of processing.

Faiqa Studio does not guarantee permanent accuracy of business data.

11. Commercial Results Disclaimer

Faiqa Studio's service is focused on prospect research, targeting, and data quality.

The service does not guarantee:
  • Email open rates
  • Reply rates
  • Meetings
  • Sales opportunities
  • Revenue
  • Closed deals

Commercial outcomes depend on factors outside the list-building process, including the Client's offer, messaging, sales process, market conditions, timing, and execution.

12. Refund Policy

Because custom prospect lists are researched and produced specifically for the Client and constitute digital deliverables, payments are non-refundable once production has commenced, except where otherwise required by applicable law or expressly agreed in writing.

The 50% advance payment becomes non-refundable once research or production work has started.
